How Trademark Engine’s Filing Process Works

At checkout, each of your ordered items will appear as separate line items. This will include any upgrades you selected and, in most cases, a free trial for Trademark Monitoring+ subscription, which helps you spot copycats and start the enforcement process. You can remove items and make edits before you pay. You can contact us to cancel your Trademark Monitoring+ protection during the free trial period without any additional cost. Otherwise, the subscription will renew after the trial period at the price and term indicated at the checkout page. It’s a flat transparent fee to avoid surprises, unlike mysterious hourly fees you see after the fact with many law firms. Trademark Engine service fees are separate from USPTO government filing fees.
Trademark Engine Goes to Work for You
Immediately after you order, the engine revs up to create your account and begin the automated conflict checks process. We also assign your order to the Swyft Legal support staff who will begin reviewing your order details. Swyft Legal is the law firm that provides legal services for Trademark Engine customers. Then, we will collect the initial applicable fee of $450 from you. We don’t do this at checkout because we need the initial clearance to do the account set- up. This fee structure may include Trademark Engine service fees, USPTO filing fees, and any other applicable charges based on your filing details. The applicable fee collection covers one USPTO class filing fee of $350 and $100 for additional services and account setup. This happens within three days of your order and may happen within hours if you upgraded your processing speed.
Monitor Your Email
Each time we need additional information from you, the Swyft Legal support staff will reach out to you via email to gather more information or clarity. The faster you respond, the faster we can get your application filed. Please keep an eye on the email you provided with your order.
Swyft Legal Attorney Review
After you work with the support staff to gather the information, the experienced lawyers of Swyft Legal will review your materials and work to improve the chances the USPTO will approve your application. The lawyers may reach out to you via email to approve any additional changes. If your package included a consult, it will usually be scheduled at this time to finalize your application. If you seek to register your trademark in more than one class, then you will be asked to pay additional fees of $450 per class at this point, to cover the required USPTO filing fee of $350 for the additional class and $100 to compensate the attorney for the additional analysis that will be required to prepare your application with respect to the new class. You may also be required to pay fees of $200 per class if you are not able to or choose not to use the USPTO ID manual for your description. But don’t worry, you and your attorney can work together to minimize those fees.
Final review, signature, & filing
You will provide a final approval of the application and pay any additional fees if you choose to file in more than one class. You will receive a link for you to sign off on the facts in the application electronically. Once we electronically receive your signature, we will file it with the USPTO and the Swyft Legal lawyers will sign as your attorney. You will receive a serial number for your application. This is what sites like Amazon’s Brand Registry require. Within a few business days, your application will appear on the USPTO database.
The USPTO examines your application, & we help you track the progress
The USPTO will assign an “examiner” to review your application. We will track the progress of your application and keep you informed every step of the way. If there is an issue, the examiner will either reach out to you or us for an informal resolution or the examiner will issue a formal Office Action. You have 90 days to respond to an Office Action, and we will be there to support you. If there is no Office Action, the USPTO takes approximately 6-12 months to process the applications. If you ordered expedited processing, your order will move to the top of the list with Trademark Engine resulting in a faster application filing. It does not change how quickly the USPTO processes your application. There are no means to pay or request the USPTO to speed up its process. When you file and your application is pending, you can put a small “™” by your logo, name or slogan. Once your application is registered, you can include ®.
