How much does it cost to trademark my brand?

Your total cost has three parts: our service fee, the USPTO government filing fee, and a Swyft Legal Filing Fee. At checkout, we collect the fees related to our service fees and any upgrades like rushed processing or more comprehensive searches. We collect an initial USPTO filing fee of $350 and Swyft Legal Filing Fee of $100 after we run a conflict checks. If your application seeks registration in multiple classes, there will be additional fees, but we work with you before any additional filing fees are collected. What happens after I submit my order?

You can read How it Works for more details. Essentially, once you place your order and conflicts are cleared, we will collect additional information from you. If you did not complete the process right after check out, please check the email you provided with your account because we will use that as our primary contact source. We will review your answers and ask any follow ups. You may need to upload a logo or a specimen with your order. You will also have an opportunity to review all applicable filing fees. If your order includes a live attorney consult, you can schedule that to finalize the filing. We will then prepare the application. You will receive an email to sign the application. Once we receive your signature, we file your application. We will keep you updated as your application works it way through the USPTO which may take anywhere from 6-12 months.

How do I check the status of my trademark?

Log in to your account at trademarkengine.com/myaccount/ to see your current stage. You can also look up your serial number directly on the USPTO's TSDR system at tsdr.uspto.gov for the official government record. Your serial number is included in your Trademark Engine account, so you have access to it at all times.

Some of the more important statuses while your application works its way through the USPTO are:

  • Filed: Application submitted to USPTO, awaiting assignment to an examiner.
  • Under examination: USPTO examining attorney is reviewing your mark.
  • Office Action issued: USPTO has questions or objections, and a response is required.
  • Published: Your mark is in the 30-day public opposition window.
  • Registered: Your trademark is officially registered.
USPTO examination timelines are outside our control. No news for months after filing is normal we'll notify you the moment your status changes.

What is an Office Action and why did I get one?

An Office Action is a formal letter from the USPTO examining attorney raising a legal issue with your application it does not mean your application is denied. Common reasons include: likelihood of confusion with an existing mark, a description that needs clarification, or a procedural issue with your specimen. You typically have 90 days to respond, or your application will be abandoned. We can help you with your Office Action Response. Keep tabs on your email or check your status in your account and order a response from there.

What is a trademark and what does it protect?

A trademark protects the brand identifiers customers use to recognize you your business name, logo, slogan, or a combination. It gives you the legal right to stop others from using a confusingly similar mark for related goods or services.

Do I need a trademark, or is a business registration enough?

They protect different things. Forming an LLC or corporation registers your business name with the state it doesn't stop a competitor in another state from using the same name. A trademark protects your brand nationwide, regardless of where you're incorporated.

What's the difference between ™ and ®?

™ can be used anytime you're claiming a brand as yours, with or without a registration. ® can only be used once your trademark is officially registered with the USPTO using it before registration is a legal violation.

How do I know if my trademark name is available?
