What Is a Statement of Use Extension?

A Statement of Use extension is a filing submitted to the United States Patent and Trademark Office (USPTO) that requests additional time to begin using your trademark in commerce.

If you filed your trademark application on an intent-to-use basis and are not yet using the trademark, an extension allows you to keep your application active without filing a Statement of Use yet.

You need a Statement of Use extension if your trademark is not yet being used in commerce when your filing deadline arrives.

Trademark Not in Use

If you are not yet selling goods or providing services under your trademark, you cannot file a Statement of Use and may need an extension.

Extensions are available only after the USPTO issues a Notice of Allowance for an intent-to-use trademark application.

How Many Statements of Use
Extensions Are Allowed?

The United States Patent and Trademark Office (USPTO) allows Statement of Use extensions in six-month increments.

You may request multiple extensions if your trademark is still not in use, as long as each extension request is filed on time and meets USPTO requirements.


Each extension request requires a separate USPTO filing fee. If a deadline is missed, the option to request an extension may no longer be available.

After the USPTO issues a Notice of Allowance, you must file a Statement of Use or request an extension within a required time frame to keep your trademark application active.


Six-Month Deadline: Each extension request must be filed within six months of the Notice of Allowance date or the current extension deadline.


USPTO Filing Fees: Each Statement of Use extension requires a separate USPTO filing fee.


Risk of Abandonment: If you miss a deadline and do not file a Statement of Use or a valid extension request, your trademark application may be abandoned.
